These Terms of Service ("Terms") govern access to and use of the ProLogELD mobile application, website, fleet dashboard, supported ELD hardware integrations, and related services (collectively, the "Services") provided by Carriage LLC under the ProLogELD name. By accessing or using the Services, you agree to these Terms.
ProLogELD provides electronic logging and fleet-management technology for commercial transportation operations. Users must use the Services only for lawful purposes and in accordance with applicable transportation, safety, employment, privacy, and other laws and regulations.
Drivers remain responsible for accurately recording, reviewing, annotating, editing where permitted, and certifying their duty-status records and for complying with applicable Hours of Service requirements. Motor carriers remain responsible for their regulatory obligations, account administration, driver and vehicle assignments, review of records, permitted carrier edits, retention obligations, and the lawful operation of their fleets.
Technology does not replace a driver's or carrier's responsibility to comply with applicable law. Users must not falsify records, misuse ELD functions, share credentials improperly, interfere with automatic driving records, or attempt to circumvent safety or compliance controls.
You must provide accurate account information and protect your login credentials. You are responsible for activity conducted through your account except to the extent prohibited by law. Notify ProLogELD promptly at support@prologeld.com if you believe an account or device has been compromised.
Certain features depend on compatible vehicle hardware, Bluetooth, GPS/location services, cellular or internet connectivity, mobile-device permissions, vehicle data availability, and third-party networks. Users are responsible for using compatible equipment and for maintaining required device and network access. Temporary loss of connectivity or hardware communication may affect synchronization or availability of certain features.
The Services may provide functions for creating, reviewing, certifying, displaying, exporting, or transferring ELD records. Users are responsible for verifying records before certification or transfer and for following applicable roadside-inspection and data-transfer procedures. ProLogELD may preserve original records, edits, annotations, certifications, diagnostic events, and other audit information as required by system design or applicable rules.
Some Services may require a paid subscription, hardware purchase, or separate commercial agreement. Prices, billing terms, trial terms, hardware terms, and fleet-specific arrangements presented at purchase or in an order, quote, or service agreement form part of the applicable agreement. App download availability does not itself include a paid ProLogELD service subscription or ELD hardware.
You may not misuse the Services, attempt unauthorized access, disrupt the Services, reverse engineer or circumvent security except where such restriction is prohibited by law, use another person's account without authorization, introduce malicious code, use the Services to falsify regulatory records, or use the Services in a manner that violates applicable law or the rights of others.
We may update, maintain, improve, add, or discontinue features as reasonably necessary. We may suspend access when necessary for security, maintenance, legal compliance, nonpayment, misuse, or protection of the Services. We do not guarantee uninterrupted operation, particularly where functionality depends on vehicles, hardware, mobile devices, GPS, Bluetooth, internet access, or third-party infrastructure outside our control.
ProLogELD and its software, branding, website content, designs, and related materials are owned by or licensed to Carriage LLC and are protected by applicable intellectual-property laws. Subject to these Terms and any applicable commercial agreement, users receive a limited, non-exclusive, non-transferable right to use the Services for their authorized business operations.
Our collection and use of personal information is described in the ProLogELD Privacy Policy.
To the maximum extent permitted by applicable law, the Services are provided on an "as available" basis. ProLogELD does not warrant that every vehicle, device, network, or third-party service will operate without interruption or error. Nothing in the Services constitutes legal advice, and users remain responsible for determining and satisfying the laws and regulations applicable to their operations.
To the maximum extent permitted by applicable law, Carriage LLC and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, or loss of data arising from use of or inability to use the Services. Any limitations in a separate written commercial agreement will also apply to the extent permitted by law.
You may stop using the Services at any time, subject to any subscription or commercial agreement. We may suspend or terminate access for material breach, unlawful or unsafe misuse, security risk, or other grounds permitted by an applicable agreement or law. Regulatory or legally required records may be retained after termination as described in our Privacy Policy.
We may update these Terms from time to time. The current version and effective date will be posted on this page. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by applicable law.
